Omission (law)

An omission is a failure to act, which generally attracts different legal consequences from positive conduct. In the criminal law, an omission will constitute an actus reus and give rise to liability only when the law imposes a duty to act and the defendant is in breach of that duty.

Omission bias

Omission bias is the tendency to favor an act of omission over one of commission. It can occur due to a number of processes, including psychological inertia, the perception of transaction costs, and a tendency to judge harmful actions as worse, or less moral, than equally harmful omissions .

Omissions in English criminal law

The issue hinges on whether the islands of Taiwan, Penghu, Kinmen, and Matsu should remain the territory of the ROC as an effectively separate self-governing entity; become part of the PRC under the existing communist government; convert the ROC to a new "Republic of Taiwan"; unite with the mainland under the ROC government (after the dissolution of the PRC government); or merge with the mainland under newly-formed alternative (federal) government (such as Federal Republic of China or United States of China).
